Pushy Birds Terms of Use
By downloading or using Pushy Birds (“the app”) you agree to these terms and to Apple’s Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/), which applies to every App Store app.
1. Health and safety
Pushy Birds is a game that involves physical exercise. It is not medical advice or a training program. Consult a physician before beginning any exercise routine, stop immediately if you feel pain, dizziness, or discomfort, and exercise in a clear space where you cannot hit anything. You are responsible for your own safety and for using the app in a way that is appropriate for your health and fitness level.
2. License
We grant you a personal, non-transferable, non-exclusive license to use the app on Apple devices you own or control, as permitted by the App Store terms.
3. Purchases
In-app purchases (character skins, Aviary Pass, Remove Ads) are non-consumable, processed by Apple, and tied to your Apple ID. They can be restored on any of your devices via “Restore purchases”. Refunds are handled by Apple under its policies. The Aviary Pass includes every flyer available now and any flyer we add in future updates, for as long as the app is available.
4. Fair play
Leaderboard scores are reviewed by simple automated checks. We may hide scores that appear not to come from real push-ups. Please don’t try to game them; it’s a push-up app.
5. Advertising
The free version shows ads served by Google AdMob. See the Privacy Policy (https://pollox.ai/pushybirds/privacy) for details and choices.
6. Changes and availability
We may update, change, or discontinue the app or any feature at any time. We’ll try to keep purchased content working for as long as the app is on the App Store.
7. Disclaimer and limitation of liability
The app is provided “as is”, without warranties of any kind. To the maximum extent permitted by law, we are not liable for any injury, loss, or damage arising from your use of the app, including from exercising.
